Official Rules
Sponsor: Olipop, Inc., 360 Grand Ave #259, Oakland, California 94610. Administered by Olipop.
PROMOTION PERIOD: The OLI-Day Cheer Challenge (“Promotion”), a special event for the OLIPOP Loyalty Program (the “Program”) begins on November 5, 2025 at 7:00 AM Pacific Time (“PT”) and ends on December 31, 2025 at 11:59:59 PM PT (“Promotion Period”). The Promotion is governed by these Official Rules and is subject to all applicable federal, state and local laws. The Administrator’s computer is the Promotion official clock.
ELIGIBILITY: This Promotion is open only to individuals who are legal residents and physically located in one (1) of the fifty (50) United States (including the District of Columbia) and who are at least eighteen (18) years old at the date and time of entry.
Participation is limited to individuals for personal use only and is limited to one (1) account per person. We may request proof of eligibility from you at our discretion. This Promotion is void where prohibited by law.
Employees, officers and directors of Sponsor, Administrator and each of their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies (collectively, “Promotion Entities”), and each of their immediate family members (e.g., spouse, parent, child, grandchild, sibling, and their respective spouses and the “steps” of each, regardless of where they reside) and persons living in the same household of each, whether or not related, are not eligible to enter or win a prize in this Promotion. For purposes of this Promotion, persons living in the same household shall mean people who share the same residence at least three (3) months a year, whether legally related or not.
Void where prohibited by law. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions and interpretations, which are final and binding in all matters related to the Promotion.
Changes to Promotion Terms: OLIPOP reserves the right to modify or cancel the Promotion or its Terms at any time in its sole discretion. Continued participation constitutes acceptance of any modifications.
HOW TO PARTICIPATE:
During the Promotion Period, an eligible entrant must go to drinkolipop.com/holiday (collectively the “Website”).
Each entrant may enroll online at drinkolipop.com/holiday by following the prompts to create an account and enroll. Required information for sign-up includes your first and last name, valid email address, and password. Your account will give you access to our online shopping experience and the Program. If you already have an account set up on our Website, you can click the “Sign Up” button on that same page or otherwise follow the instructions made available by us on our Website. Following enrollment, you can also optionally elect to complete your profile with additional information like your birthday, bio, home address, future product “wish list,” and mobile phone number, or even a profile pic, Some Rewards require additional information from you. For example, we need your address to ship physical Rewards.
If any Entry or receipt fails to comply with any entry requirements or any other provisions of these Official Rules, at the Sponsor’s sole discretion, Sponsor reserves the right to disqualify the entrant.
How to Cancel: You may cancel your membership at any time via account settings or emailing (hello@drinkolipop.com). Termination may take up to 30 days. All Points and Rewards will be void upon cancellation. Re-enrollment will be treated as a new membership. Account deletion is subject to the Privacy Policy.
EARNING POINTS: Participants may earn points by completing designated activities on drinkolipop.com and through eligible purchases of OLIPOP from an authorized retailer with an upload of a valid receipt.
Points Earned for Valid OLIPOP Purchases
Earn 100 points per $1 spent on OLIPOP at any retailer when you upload your receipts. Purchases must be made by 11:59p PT December 31, 2025, and receipts uploaded by 11:59p January 6, 2026. Purchases made from drinkolipop.com receive an additional 50 points per dollar spent (total 150 points per dollar spent). Limit one receipt upload per day per account. Purchases made directly from Olipop will have points automatically uploaded, and a receipt does not need to be submitted.
How to Submit a Receipt: Participant must be logged into their account and follow the prompts at drinkolipop.com/holiday to submit a photo with proof of purchase as directed (the “Submission”). Any photos must be of acceptable file type (.png, .jpeg) and file size (less than 10MB). Submission must be received before the end of the Promotion Period.
Each receipt may only be uploaded once. Receipt must clearly show the purchase of an Olipop itemdate of purchase, and retailer. Any attempt to manipulate, alter, duplicate, or otherwise edit the original receipt, at Sponsor’s sole discretion, will result in disqualification and potential legal actions pertaining to fraudulent behavior. Sponsor reserves the right to reject any Submission that appears to be fraudulent or does not comply with these Terms and Conditions. Duplicate or suspicious Submissions may be subject to further verification.
Purchase Verification: The uploaded receipt will then be verified within 3-10 business days by the Sponsor. You will receive a notification of whether the Submission has been approved or rejected. If Sponsor determines, in their sole discretion, that a Submission is invalid and therefore rejected, you will be notified of the reason for their determination via the email address provided. Rejected Submissions will have the opportunity to upload a qualifying receipt of purchase by the end of the Promotion Period by following the steps in the rejection notification. If rejected again, or a resubmission is not attempted, the Submission is void and a new Submission must be attempted.
The Sponsor may, at any time, disqualify any participant who is not acting in accordance with these Terms & Conditions or who tampers with the Promotion process. All decisions by the Sponsor are final. Failure by the Sponsor to enforce any of their rights at any stage does not constitute a waiver of those rights.
Points Earned for “Activities”
Take a Selfie with a Yeti
To participate in this activity, Participant must be logged into their account and follow the prompts to upload a photo of themselves with one of OLIPOP’s Yeti cans (Vintage Cola, Ginger Ale, and Crisp Apple). Submissions are subject to review before Points are awarded. Earn 25 points for each can featured. Multiple photos with the same can do not receive additional points.
Hug a Virtual Yeti
To participate in this activity, Participant must be logged into their account and find the “Hug a Virtual Yeti” button on drinkolipop.com. Each hug/click earns 2 points. Participants can “hug” up to 57 times (114 points total).
Point Balance
Participants may access and update information and access account status, including points balance, by logging in to their OLIPOP account. Points will typically appear within one (1) to two (2) business days of the date a qualifying purchase is processed. Points earned in connection with other Activities will typically appear within the time period identified in connection with each Activity, or if no time period is identified, within three (3) business days of your verified completion of the applicable Activity.
Point, Rewards, and/or any other Program Offers are promotional and have no cash or other pecuniary value, cannot be exchanged for cash, are not gift certificates, and have no value outside of this Program. Program Offers cannot be sold, shared, gifted, assigned, bartered, or otherwise transferred, provided that if a Reward is expressly transferrable, you can transfer such Reward in accordance with its specific, applicable terms. No credit or cash will be given for unused points. You have no ownership interest in Points, Rewards, your account, or any other Program Offers and Program Offers maybe revoked by OLIPOP at any time as set forth in these Program Terms and Conditions. Use of the word “earn” is meant to mean “collect” and “spend” is meant to mean “use.”
If you reasonably believe points were not properly credited to your account, you must notify us by contacting hello@drinkolipop.com within thirty (30) days of the date on which such points should have been awarded per these Program Terms and Conditions. You agree that our determination with respect to Points accrued shall be final. OLIPOP reserves the right to determine the number of Points in your account based on our internal records. Our internal records will be deemed accurate and in the event of any inconsistency between the number of Points stated in your account and OLIPOP’s records, our records control. OLIPOP can adjust or void Points at any time, consistent with these Program Terms and Conditions.
Points Expiration
Points expire automatically one (1) year from the date earned. Expired Points cannot be reinstated.
Once you redeem your Points for Rewards, those Points are considered used, and they won’t be refunded, reinstated or reversed.
No Retroactive Points
Points will not be credited for in-store purchases prior to the Promotional Period, starting November 5, 2025. No retroactive awards, except at OLIPOP’s discretion.
REWARDS
Points may be redeemed for Rewards including free product and merch. Rewards are subject to availability, substitutions, and expiration (e.g., 30 days for certain offers). Rewards cannot be exchanged for cash or combined with some promotions.
The required number of Points will be subtracted from your Points balance following your Reward selection. Redemptions are final. Rewards may change over time depending on availability as well as member interest. Current Rewards and the number of Points required to redeem, as well as additional instructions related to specific Rewards, are available within the account. There may be a limited number of particular Rewards available, and those Rewards will be provided on a first-come, first-served basis while supplies last.
OLIPOP reserves the right to modify, amend, or revise the Rewards or any Program Offers. Participants may not rely on the continued availability of a particular Reward. The number of Points required to redeem a Reward may be substantially increased, any Reward may be withdrawn, and restrictions on redemption may be imposed by OLIPOP or the third party supplying the Reward (if any). Physical Rewards will be shipped to U.S. addresses only (50 U.S. and DC, no P.O. Boxes). OLIPOP reserves the right to substitute Rewards of comparable or greater value if any Reward becomes unavailable for any reason. Unless otherwise specified, physical Rewards will be fulfilled within six to eight weeks from date of redemption. Rewards pictured in any point-of-sale, online, promotional packaging, advertising, and/or other OLIPOP materials are for illustrative purposes only. The actual Reward may vary from the Reward pictured.
WAIVERS AND RELEASES: By participating in this Promotion, entrants agree that the Promotion Entities, and each of their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers and each their respective officers, directors, stockholders, employees, representatives, designees and agents (collectively with the Promotion Entities, the “Released Parties”) are not responsible for: (i) lost, late, incomplete, stolen, misdirected, postage due or undeliverable e-mail/text notifications or postal mail; (ii) any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability; (iii) garbled, corrupt or jumbled transmissions, service provider/network accessibility, availability or traffic congestion; (iv) any technical, mechanical, printing or typographical or other error; (v) the incorrect or inaccurate capture of registration information or the failure to capture, or loss of, any such information; (vi) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Promotion; (vii) any injury or damage, whether personal or property, to entrants or to any person's computer related to or resulting from participating in the Promotion and/or accepting a Prize; and (viii) entries that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted, damaged, garbled or otherwise not in compliance with the Official Rules. Further, the Released Parties are not responsible for any unanswered or undeliverable winner notifications.
By entering the Promotion, each entrant agrees: (i) to be bound by these Official Rules, including entry requirements; (ii) to waive any rights to claim ambiguity with respect to these Official Rules; (iii) to waive all of his/her rights to bring any claim, action or proceeding against any of the Released Parties in connection with the Promotion; and (iii) to forever and irrevocably agree to release, indemnify, defend and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable attorneys’ fees) that may arise in connection with: (a) the Promotion, including, but not limited to, any Promotion-related activity or element thereof, and the entrant’s entries, participation or inability to participate in the Promotion; (b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or willful misconduct in connection with the use of a Prize (or any component thereof); (d) any change in the prizing (or any components thereof); (e) human error; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (g) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof); or (h) the negligence or willful misconduct by entrant. If, for any reason, the Promotion is not capable of running as planned, Sponsor reserves the right, at its sole and absolute discretion, to cancel, terminate, modify or suspend the Promotion and/or proceed with the Promotion, including the selection of a winner in a manner it deems fair and reasonable, including the selection of a winner from among eligible entries received prior to such cancellation, termination, modification or suspension. In no event will more Prizes be awarded than are stated in these Official Rules. In the event that, due to technical, typographical, mechanical, administrative, printing, production, computer or other errors, there are more winners than are stated in these Official Rules, a random drawing among the claimants will be held to determine the winners. Notice of such cancelation, termination, or modification of the Promotion shall be posted at the Website(s). Sponsor additionally reserves the right, in its sole and absolute discretion: (a) to modify, suspend or terminate the Promotion should causes beyond Sponsor’s control corrupt or interfere with the administration, integrity, operation, security or proper play of the Promotion; or (b) to disqualify any entrant found to be, or suspected of: (i) tampering with the entry process or the operation of the Promotion; (ii) acting in violation of these Official Rules; or (iii) acting in an un-sportsmanlike manner.
WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS PROMOTION, INCLUDING THE PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
PRIVACY: Sponsor’s privacy policy is available at https://drinkolipop.com/pages/privacy-policy. As a condition of entering the Promotion, each participant gives consent for Sponsor to obtain and deliver his or her name, address and other information to third parties for the purpose of administering this Promotion and to comply with applicable laws, regulations and rules. Any information participant provides to Sponsor may be used to communicate with participant in relation to this Promotion.
PUBLICITY RIGHTS: By participating in this Promotion, each participant agrees to irrevocably allow the Sponsor and Sponsor’s designee the perpetual right to use his/her name, address (city and state), biographical information, likeness, picture and other information and content provided in connection with the Promotion for promotion, trade, commercial, advertising and publicity purposes in all media worldwide, including, but not limited to, on television and the Internet, without notice, review or approval and without additional compensation, except where prohibited by law.
GENERAL: Any attempted form of participation in this Promotion other than as described herein is void. Sponsor and Administrator reserve the right to disqualify any participant found or suspected, in their sole and absolute discretion, to be tampering with the operation of the Promotion; to be acting in violation of these Terms and Conditions; or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of this Promotion. Any attempted form of participation in this Promotion other than as in these Terms and Conditions is void. If it is discovered that a person has participated or attempted to participate more than once using multiple phone numbers, e-mail addresses, residential addresses, multiple identities, IP addresses, use of proxy servers, or like methods, all of that person’s Submissions will be declared null and void and that person will not be awarded any Reward that he/she might have been entitled to receive. Any use of robotic, automatic, macro, programmed, third party or like methods to participate in the Promotion will void any attempted participation effected by such methods and the disqualification of the individual utilizing the same. Participants may be required to provide proof of identification and eligibility as required by Sponsor or Administrator. In the event of a dispute as to the identity of a participant, the Submission will be declared made by the authorized account holder of the email address used to enter. “Authorized account holder” is defined as the natural person who is assigned to the e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution) that is responsible for assigning e-mail addresses for the domain associated with the e-mail address. Each participant may be required to show proof of being an authorized account holder. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. Sponsor and Administrator reserve the right to disqualify any individual found, in its sole opinion, to be tampering with the operation of the Promotion, to be acting in violation of these Terms and Conditions or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of a Promotion. Any use of robotic, automatic, macro, programmed, third-party or like methods to participate in the Promotion will void any attempted participation effected by such methods and the disqualification of the individual utilizing the same. CAUTION: ANY ATTEMPT TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. If any provision of these Terms and Conditions or any word, phrase, clause, sentence, or other portion thereof should be held unenforceable or invalid for any reason, then that provision or portion thereof shall be modified or deleted in such manner as to render the remaining provisions of these Terms and Conditions valid and enforceable. The invalidity or unenforceability of any provision of these Terms and Conditions or the Reward documents will not affect the validity or enforceability of any other provision. No participant shall have the right to modify or amend these Terms and Conditions. Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision and such provision shall remain in full force and effect. All submissions and/or materials submitted become the property of Sponsor and will not be returned. In the event of any conflict with any Promotion details contained in these Terms and Conditions and Promotion details contained in any promotional materials (including, but not limited to, point of sale, television and print advertising, promotional packaging and other promotional media), the details of the Promotion as set forth in these Terms and Conditions shall prevail.

Participation constitutes Entrant’s full and unconditional agreement to these Official Rules. Sponsor’s and Administrator’s decisions are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Timing: The Sweepstakes will begin on November 5, 2025 at approximately 7:00 AM Pacific Time (“PT”) and will end on December 31, 2025 at 11:59 PM PT (the “Sweepstakes Period”). Sponsor’s computer is the official clock for the Sweepstakes.
The Sweepstakes Period will be broken into eight (8) individual weekly entry periods (each, a “Weekly Entry Period”). The Weekly Entry Periods will take place according to the following schedule:

How to Enter:
There are two (2) ways to enter the Sweepstakes:
1. OLIPOP Purchase at Retail. Visit a participating in-store or online retailer (online includes purchases made on drinkolipop.com and all other online retailers) and purchase OLIPOP product(s). Then, during the Sweepstakes Period using your mobile phone, take a photo of your receipt that clearly includes the purchase date, store name/location and eligible OLIPOP product(s) purchased. Visit drinkolipop.com/holiday and follow the on-screen instructions to create an OLIPOP Loyalty account, upload your store receipt photo and submit during the Sweepstakes Period to receive one (1) entry into the Sweepstakes. Receipts must be dated during the Sweepstakes Period. You will receive one (1) entry for each receipt submitted. IMPORTANT NOTE: to be eligible for an entry, receipt photos must be uploaded and submitted by the dates set forth above on the Sweepstakes Website during the Sweepstakes Period.
2. NO PURCHASE NECESSARY – FREE ONLINE ENTRY. To enter without making a purchase (the “AMOE”), click here: www.drinkolipop.com/ocs-amoe (the “AMOE Website”) and complete the Online Entry Request (“Request”) form in its entirety with your complete name and e-mail address. Each online entry will count as one (1) entry into the random drawing corresponding to the Weekly Entry Period selected.
Limit of one (1) entry per person, per day of the Sweepstakes Period, regardless of method of entry. For purposes of these Official Rules, a ‘day’ is defined as any twenty-four (24) hour period during the Sweepstakes Period beginning at 12:00 am PT and ending twenty-four (24) hours later at 11:59 pm PT.
All entries must be received in accordance with the deadlines stated herein in order to participate. The Website’s database clock will be the official timekeeper for online entries in this Sweepstakes. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. The Sweepstakes Entities shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes.
Prizes:
One (1) Grand Prize Winner will win:
• A twelve (12) month supply of OLIPOP, as two (2) cases of OLIPOP (twelve (12) twelve-ounce (12 oz) cans per case) per month for twelve (12) months (flavor to be chosen by the winner), with an Approximate Retail Value (ARV) of thirty-four dollars and ninety-nine cents ($34.99) per case;
• One (1) OLIPOP Yeti beanie, with an ARV of fourteen dollars and twenty-five cents ($14.25); and
• A one thousand dollar ($1000) gift card, with an ARV of one thousand dollars ($1000).
Eight (8) Weekly Winners (one (1) per Weekly Entry Period) will win:
• A three (3) month supply of OLIPOP, as two (2) cases of OLIPOP (twelve (12) twelve-ounce (12 oz) cans per case) per month for three (3) months (flavor to be chosen by the winners), with an Approximate Retail Value (ARV) of thirty-four dollars and ninety-nine cents ($34.99) per case;
• One (1) OLIPOP Yeti beanie, with an ARV of fourteen dollars and twenty-five cents ($14.25); and
• A one hundred dollar ($100) gift card, with an ARV of one hundred dollars ($100).
The Grand Prize package total ARV is one thousand eight hundred fifty-four dollars and one cents ($1,854.01). Each Weekly Prize package total ARV is three hundred twenty-four dollars and nineteen cents ($324.19). The total ARV of the Sweepstakes is four thousand four hundred forty-seven dollars and fifty-three cents ($4,447.53).
Odds of winning a prize depend on the number of eligible entries received during the applicable Sweepstakes Entry Period.
Only one (1) prize package per person. Prizes cannot be transferred, redeemed for cash or substituted by the winner. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The ARV of the prize represents Sponsor’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. Sponsor will not replace any lost or stolen prize items.

Prize Drawings: On or about each of the dates indicated in the chart above, Sponsor will randomly select one (1) potential Weekly Winner from all eligible entries received during the Weekly Entry Period. Additionally, on or about January 2, 2026, Sponsor will randomly select one (1) potential Grand Prize Winner from all remaining eligible entries (eligible entries less previously selected Weekly Winners. The Winners will be notified via email on or about three (3) business days from drawing. Sponsor’s selection of the Winners is final and binding in all matters related to the Sweepstakes.
Sponsor shall have no liability for a Winner’s failure to receive notices due to Winner’s spam, junk e-mail, notifications, or other security settings on Winner’s Instagram account or for Winner’s provision of incorrect or otherwise non-functioning contact information. If the selected Winner cannot be contacted, is ineligible, fails to claim the prize within three (3) business days after the notification, the prize may be deemed to be “Unclaimed”. Unclaimed prize may be awarded to an alternate winner at the sole discretion of Sponsor. Winner may waive their right to receive prize. Prize is not assignable and not transferable. No refund, cash redemption, substitution or replacement of prize or any prize component permitted, except that Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value (or cash equivalent).
Winner is solely responsible for reporting and payment of any taxes on prizes. Winner may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of postmark. Failure to sign and return the affidavit or release within ten (10) days of receipt, or to comply with any term or condition of these Official Rules, may result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner according to the criteria set forth in these Rules.
Release: By receipt of any prize, Winner agrees to release and hold harmless Sponsor, the Promotional Partners, Prize Partner, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize.
General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other Sweepstakes or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Central District of California or the Superior Court of Los Angeles County, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

Winner List: For the Winner List, please send an e-mail to hello@drinkolipop.com with "OLIPOP OLI-Day Cheer Sweepstakes" in the subject along with the date of the relevant Sweepstakes Entry Period. Requests for the names of winners must be received no later than July 3, 2026.
